Recently had a lawyer send me information on this matter which is mostly covered above, but interestingly the employee/client bit needs expanding on... I quote from the letter sent to me: " The Copyright Act 1994 states that the author of an original work is the first owner of the copyright, however, if the author was employed or commissioned to make the work then the employer or client is the first owner of copyright." Not many people realise this, and it really isn't covered above. Hope it clarifies some questions about commissioned work that perhaps was not realised before. Have crossed this path before with being both the employee and client. So really commissioned work needs to be charged accordingly, or go joint/co ownership, otherwise the buck stops there.
